1. TERMS AND CONDITIONS

These following Terms and Conditions apply to all bookings within the Company Daniel Luke Wedding Photography.
Payment of the booking fee required by Daniel Luke Photography indicates The Client or Clients acceptance of these Terms and Conditions.
These Terms and Conditions cannot be altered by The Client or clients unless such conditions are firstly agreed with, and confirmed in writing, by Daniel Luke Photography
Daniel Luke Photography has the right to refuse any booking.

2. DEFINITIONS

In these Terms and Conditions, 'Daniel Luke Photography' shall mean the Company Daniel Luke Wedding Photography and any person working within Daniel Luke Wedding Photography to work on the Commission by The Client or Clients.
The Client or Clients shall be those person or persons defined as Bride and or Groom on the booking form, whether a direct client of Daniel Luke Photography or an agency or otherwise.
The 'Commission' shall mean the booking of Daniel Luke Photography by The Client or clients to perform photography, and editing services in consideration of the fee.
The 'Fee' will mean the Fee for completion of the Commission by Daniel Luke Photography.
'Copyright' means the ownership of and rights to the Final Materials.
'Final Materials' means the photographic images collected, edited, produced and presented by Daniel Luke Photography for the purpose of the Commission by The Client or clients, and presented in the manner and quantity agreed at the time of booking.

3. PRICES

All standard Commissions and other goods specified on the booking form or on the Daniel Luke Photography website are given at the prices on the date of booking. Any goods that are not mentioned at time of original booking are supplied at the prices ruling at the time of receipt of the additional order.

4. COVERAGE

Photography performed for the Commission will be the decision of Daniel Luke Photography although every effort will be made to comply with the requirements of The Client or Clients).
Daniel Luke Photography shall be granted artistic license in relation to the poses photographed and the locations used. Daniel Luke Photography’s judgement regarding these matters shall be deemed correct.
Daniel Luke Photography shall attempt to photograph all individuals as requested by The Client or clients but no responsibility will be taken by Daniel Luke Photography on the occasion of leaving out any person, object or scene.
When a Commission involves a church ceremony, or at certain other venues, the movements by Daniel Luke Photography might be restricted by the official in charge of the venue. The area from which Daniel Luke Photography is able to cover said ceremony may not be of Daniel Luke Photography’s choice and Daniel Luke Photography cannot accept responsibility for any obstructed view in Final Materials, should this be the case.

5. CONFIDENTIALITY

All parties shall keep confidential and will not disclose to any third parties or make use of information or material communicated to it in confidence for the purposes of the Commission.

6. PERSONAL ACCIDENT

Any directions issued to The Client or Clients, their guests or employees during a Commission are deemed to be at said persons' own risk. Daniel Luke Photography cannot be held responsible for any personal accidents during a Commission.

7. INDEMNITY

The Client or Clients shall be responsible for obtaining clearances in respect of third- party copyright works, trademarks, designs or other intellectual property and will indemnify Daniel Luke Photography against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.

8. PAYMENT

A non refundable booking fee of £200 will confirm The Client or Clients booking, as well as full acceptance of these Terms and Conditions. The booking fee will be deducted from the cost of The Client or Clients chosen package once the full balance is due.
Full payment of the remaining balance must be made four weeks before the date of the Commission. Failure by The Client or Clients to make full payment at this time without prior written agreement by Daniel Luke Photography will result in the cancellation of The Client or Clients Commission.
Additional goods ordered must be paid for in full at the time of ordering.
Titles to all goods remain with Daniel Luke Photography until paid for in full by The Client or Clients.
All orders will only be processed once comformation of The Client or Clients payment has been received.

9. EXPENSES

Where extra expenses are incurred by Daniel Luke Photography as a result of alterations to the original brief for the Commission by The Client(s), or otherwise at its request, The Client(s) shall be liable to pay such extra expenses or fees as having been agreed or estimated.

10. DELIVERY

Daniel Luke Photography shall endeavour to ensure delivery of photography and additional orders within the agreed time period.
Time for delivery shall not be the nature of the contract.
Daniel Luke Photography shall not in any circumstances be liable to The Client or Clients for any loss, whether direct or indirect occasioned by late delivery or on any other grounds whatsoever.
Clients must give approval of albums within their package by previewing this. Once this has been sent off for printing no alterations can be made.

12. REJECTION

There is no right to reject Final Materials on the basis of style or composition.

13. OWNERSHIP AND DISPLAY

All digital files (RAW + JPEG or Video Files) used during any Commission by Daniel Luke Photography remain the property of Daniel Luke Photography. RAW files will remain solely in the possession of Daniel Luke Photography and will not be given or shared to clients.
The Client or Clients hereby give permission for Daniel Luke Photography to display any photograph covered by their Commission, at any time and in any part of the world, for general business promotion in advertising, brochures, magazine articles, websites, literature and sample albums.

14. CANCELLATION AND POSTPONEMENT

If The Client or Clients should have to cancel a Commission, the following cancellation fees will become due immediately upon cancellation:
Cancellation or Postponement more than six months before the Commission - A booking fee of £200 will not be refunded.
Cancellation or Postponement less than six months before the Commission - 50% of the price of the package booked.
Cancellation or Postponement less than three months before the Commission - Full price of the package booked.
Where no package has been specified on the booking form, it will be deemed that The Client or Clients have chosen a package to the value of £1500. The Client or Clients are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.

15. FORCE MAJEURE

Daniel Luke Photography shall not be liable for any failure in the performance of any of its obligations caused by factors beyond its reasonable control.
Daniel Luke Photography will strive to provide The Client or Clients with alternative, equivalent in the event that Daniel Luke Photography is unable to attend the Commission due to any cause beyond its reasonable control, e.g. sudden illness, injury, victim of crime, flooding, etc.
In the event of cancellation by Daniel Luke Photography due to Force Majeure, or in the extremely unlikely event of total equipment failure, liability shall be limited to a full refund of any fees paid.
